DeJoria does not warrant that information contained on the website will be accurate, reliable or error-free, or that defects will be corrected. DeJoria cannot be held responsible for errors and omissions in the website and reserves the right to modify and correct errors at any time. Material on the website may also contain technical inaccuracies or typographical errors (including pricing errors) and may be changed, updated or modified at any time and from time to time without notice. DeJoria will not be liable or responsible for any such inaccuracies, errors, changes or updates. DeJoria may, in its sole discretion, add, delete or change some or all of its products and services at any time. DeJoria has attempted to accurately depict the products offered for sales on its website. However, because the depiction of a product is dependent on your computer monitor, DeJoria cannot guarantee that such depiction will be accurate. The products may also appear larger or smaller than their actual size depending on your monitor. Some photographs have been enlarged to show detail.

You understand that use of this website or materials or purchase of products may require that you have access to certain equipment or software or telecommunications services, and that DeJoria shall not be liable for providing any of these items. Any unpermitted use of the materials or any fraudulent, abusive, or otherwise illegal activity shall be grounds for termination of your right to access the website or use the materials. DeJoria reserves the right to terminate your access to the website and the materials at any time, with or without notice. You should be aware that the materials include proprietary information belonging to DeJoria and its licensors and, therefore, that you may be liable for infringement or misappropriation or other legal action if you misuse the Materials.

Unless specifically noted, this website, its content or the information available on or through it is provided on an "as is" basis without warranties of any kind, either express or implied, including warranties of title or implied warranties of merchantability or fitness for a particular purpose. You acknowledge that you use this website at your own risk, that you assume full responsibility for all costs associated with all necessary servicing or repairs of any equipment you use in connection with your use of this website, and that DeJoria and its affiliates shall not be liable for any damages special, indirect or consequential of any kind related to your use of this website.

Please note that the above disclaimer does not apply to products you may purchase through this website. Warranties and return rights concerning such products are governed by terms provided elsewhere in this website and by applicable law.

Under no circumstance shall DeJoria be liable for any indirect, special, incidental or consequential damages of any kind, regardless of the form of action, whether in contract, tort (including negligence), strict product liability of otherwise, even if we have been advised of the possibility of such damages.

ORDER ACCEPTANCE & PAYMENT
Before your order can be accepted, we must receive in cleared funds, or confirmation of authorization of payment (where a credit or debit card is used) the purchase price specified in the quotation in full (without any deduction). Once payment has been received by us, we will confirm that your order has been accepted by sending an order confirmation email to you at the email address you provide on your enquiry. Our acceptance of your order brings into existence a legally binding contract between us. You are able to make payment by credit or debit card (as specified on our website), check or wire transfer of funds. DeJoria may, at its sole discretion, cancel your order in which case DeJoria shall return any monies received from you, within 30 days of receipt of such monies to your nominated account and DeJoria shall be entitled to deduct an administration fee of $35. You agree that in any event DeJoria shall have no liability to you for any loss, damage, costs, expenses or other claims that you may incur. You agree to indemnify DeJoria in full against all costs and outgoings incurred by us in obtaining payments from you in the event that a failed payment occurs.

YOUR RIGHT TO CANCEL
Except for special order and custom engraved items, you will be entitled to cancel your order by written notice to info@dejoria.com at any time prior to us shipping the item to you. You do not need to give us any reason for cancelling your order nor will you have to pay any penalty.

OUR RIGHT TO CANCEL
We reserve the right to cancel your order if one of more of the products you ordered was listed at an incorrect price due to a typographical error in the pricing information on our website, any customer material is deemed (in our sole opinion) to be offensive, defamatory or inappropriate, or failure to perform arising from circumstances beyond our reasonable control (including - and without limitation - any act of God, communications failure, death, destruction, fire, flood, strikes, riots, accident, disruption to energy supplies, civil commotions, acts of terrorism or war). If we do cancel your order, we will notify you by email and will offer an alternative replacement product or refund to you any amounts paid to us as soon as possible and in any event within 30 days of your order. We shall not be obliged to offer any additional compensation for disappointment suffered and we shall have no liability to you for any loss, damage, costs, expenses or other claims that you may incur.

SHIPPING
As part of our insurance requirements and quality control procedure, before each product is shipped, the diamond is inserted into the packaging in the presence of a DeJoria employee and duly sealed. Delivery will be made to the address specified in the order confirmation. DeJoria reserves the right to restrict the shipping of products to certain areas. We will take all reasonable steps to ship your order to you on or before the date specified in the order confirmation, but delays may be caused by customs clearance or other circumstances beyond our reasonable control (including - and without limitation - any Act of God, communications failure, death, destruction, fire, flood, strikes, riots, accident, disruption to energy supplies, civil commotions, acts of terrorism or war), and DeJoria does not warrant or guarantee the delivery date specified in the order confirmation and shall have no liability to you for any loss, damage, costs, expenses, or other claims that you may incur as a result of late delivery. You will become the owner of the products you have ordered when they have been delivered to you. Once the products have been delivered to you, they will be held at your own risk and we shall not be liable for their loss or destruction.

WARRANTIES & REFUNDS
We warrant that the products are of satisfactory quality. DeJoria's high quality jewelry should meet or exceed your expectations. However, in the event that you are dissatisfied with your order, the products delivered to you are incomplete or you have received incorrect products, we shall have no liability to you unless you call DeJoria customer service on + 44 845 355 1164 to obtain an authorization number and notify DeJoria of the problem WITHIN 48 HOURS OF DELIVERY of the products in question. We shall remedy the breach of the warranty by any of the following methods; we may refer you to a local jeweler associated with DeJoria to rectify the fault at the cost of DeJoria, or we may offer you an alternate product free of charge within 60 days of notification, or we will arrange with you for the products to be returned to us and we shall refund the price paid. AND IN EACH CASE, DEJORIA SHALL HAVE NO FURTHER LIABILITY TO YOU.

RETURNS PROCEDURE
If, for any reason, you are not satisfied with your purchase, you can return any item in its original condition within 30 days of the date of shipment for a refund or exchange. You can do this by -

1 - Call our customer service helpline on + 44 845 355 1164 within 5 days of receiving your item to obtain an authorization code. You must obtain this code before any return is shipped. Include this code on the returns form provided with your original package.

2- Package the item securely, including all original packaging and any certificates / documents that accompanied the item. Please note that if the documentation is not returned, then you will be liable for the $250 replacement cost.

3 - Insure your package. For items with value less than $500, you can ship it by any carrier (eg FedEx, UPS or US Postal Service). Please ensure that your item is fully insured and request a receipt for the transaction. For items with value greater than $500, ship your package by US Postal Service Registered Mail, fully insured and request a receipt for the transaction (FedEx and UPS will NOT insure merchandise with a value over $500). YOU are responsible for the costs associated with this.

DO NOT indicate parcel contents on the outside of your shipment as this invites possible theft and / or damage.

5 - You will be notified by email when we have received your item/s and when we have processed your refund. The refund will be for the full price of the item/s you purchased from DeJoria less our original shipping costs. Your refund will be processed within 30 days of receiving the returned item/s.

There are some conditions of return:

1 - Packages without an authorization code will not be accepted for refund
2 - Items must be returned in the same condition as shipped by DeJoria
3 - Any returns showing signs of wear or those that have been engraved, altered, resized (by a jeweler other than DeJoria), or damaged in any way will not be accepted for return
4 - Special or custom orders will only be eligible for return if faulty (ie manufacturing, setting etc). Special or custom orders cannot be resold as they have specifically been contoured or manufactured to each individual client.

LINKS TO OTHER SITES
DeJoria makes no representations or warranties about any other website you may access through this website. If there is a link to another website, such link does not constitute an endorsement of that site or the products or services contained therein and is provided solely as a convenience to you.

USER COMMUNICATIONS
Any message you send to us via email, postcard, letter, voicemail or other transmission relating to your use of this website, other than an actual order of merchandise, shall be and remain the property of DeJoria, and DeJoria shall not be limited in any way in its use, promotional, commercial or otherwise. However, we will not use your name in any such promotional use without your permission. You agree that no such messages will violate the rights of any third party or contain any libelous or otherwise unlawful materials. We save certain messages and emails on file for promotional and marketing purposes, but we are not required to and do not retain every such message.
